Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the HajjMate mobile application and website at hajjmate.app (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms.
1. Who we are
HajjMate is a digital companion designed to help pilgrims with ritual guidance, prayer tools, journey tracking, nearby services, and an AI assistant. The Service is provided for informational and organisational support.
2. Eligibility & accounts
You must be legally able to enter into these Terms in your jurisdiction. Some features require an account via Google or Apple Sign In. You are responsible for activity under your account and for keeping sign-in credentials secure. Guest browse may allow limited use without an account.
3. Not religious or legal advice
HajjMate provides general educational and practical tools. Content — including guides, checklists, AI answers, news, and alerts — is not a fatwa, scholarly ruling, or professional advice. Ritual practice can differ by madhab and personal circumstance. When in doubt, consult a qualified scholar or your group leader. AI responses may be incomplete or incorrect.
4. Acceptable use
You agree not to:
- Misuse the Service, attempt unauthorised access, or disrupt our systems.
- Upload unlawful, harmful, or infringing content.
- Reverse engineer or scrape the Service except as allowed by law.
- Use the Service in a way that endangers yourself or others (for example, looking at your phone while walking in crowded ritual areas).
5. Location & safety
Location-based features (Qibla, counters, services, alerts) depend on device sensors, GPS accuracy, permissions, and third-party maps. They may be delayed or inaccurate. Always prioritise your safety, local instructions, and official guidance over the app.
6. Third-party services
The Service may link to maps, app stores, sign-in providers, news sources, or other third parties. Their terms and privacy policies apply to those services. We are not responsible for third-party content or availability.
7. Intellectual property
HajjMate branding, app design, and original content are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You may not copy or redistribute our materials without permission, except for personal use of content you legitimately access in the app.
8. Subscriptions & store purchases
If any paid features are offered, fees, renewals, and refunds are handled according to the Apple App Store or Google Play terms applicable to your purchase, unless we state otherwise.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that prayer times, geofencing, directions, or AI answers will be accurate in every case.
10. Limitation of liability
To the fullest extent permitted by law, HajjMate and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or pilgrimage-related costs arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) USD 50, if no fees were paid.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by nature should survive (including disclaimers and limitations) will survive termination.
12. Changes to the Terms
We may update these Terms by posting a new version on this page. The “Last updated” date will change. Continued use after updates constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles, unless mandatory consumer protections in your country require otherwise. Courts in Dhaka, Bangladesh shall have exclusive jurisdiction, subject to any non-waivable rights you may have.
